The agreement between you and ARTE DEALS covering how the marketplace works, what each of us is responsible for, and what happens when something goes wrong.
These Terms of Service form a binding agreement between you and ARTE DEALS. By creating an account, posting a listing, sending a message, or otherwise using the site, you confirm that you have read these terms and agree to be bound by them, together with our Privacy Policy.
If you do not agree with any part of this agreement, do not use ARTE DEALS.

ARTE DEALS is a listing platform. We provide the space where people who want to sell vehicles can present them, and where people who want to buy can find them and make contact.
Every sale is a private transaction between a Buyer and a Seller. ARTE DEALS is not a party to it.
Where the Platform shows an estimated monthly amortisation, that figure is indicative only. It is generated from illustrative flat rates for convenience and does not constitute a loan offer, a quotation, or approval of financing. Actual terms depend entirely on the financing institution and the applicant's circumstances.
Creating an account requires a working email address, which you must confirm using the verification code we send. Accounts remain unverified, and unusable, until that code is entered.
Additional accounts created to circumvent listing limits, evade a suspension, or artificially inflate activity may be removed without notice.
ARTE DEALS will never ask for your password, your verification code, your GCash MPIN, or any one-time PIN. Anyone who does is attempting to defraud you. Report them to us immediately.
At sign-up you choose a role, which determines what you can do:

A Buyer may convert to a Seller account at any time from their account page, keeping their saved vehicles and message history.
By posting a Listing you represent and warrant that:
Mark a vehicle as sold, or remove the Listing, once it is no longer available. Leaving sold vehicles live wastes Buyers' time and may result in your Listings being removed.
The same vehicle may not be listed more than once by the same Seller. Duplicate Listings are blocked automatically and may also be removed manually.
Listing allowances run in two-week Cycles. A Seller's Cycle begins with their own first Listing, so every Seller receives a full two weeks regardless of when they join.

PRO is an optional paid subscription for Sellers. It includes:
A PRO subscription runs for one month from the date of activation.
PRO does not renew automatically and no recurring charge is ever made. When the month ends the account reverts to Standard. To continue, the Seller makes a new payment and submits a new reference number.
When PRO expires, the Seller's allowance returns to three Listings per Cycle. Listings already posted are not deleted, but the Seller cannot post beyond the Standard limit until the next Cycle or until PRO is renewed.
PRO is priced at ₱129 per month, offered at a promotional ₱79 during the launch period. Prices are in Philippine Pesos and may change; any change applies only to subscriptions purchased afterwards.
Payment is made by GCash to the account shown on the upgrade page, which is visible only to signed-in Sellers. After paying, the Seller submits the GCash reference number through the Platform. We verify it manually and activate PRO, ordinarily within a few hours.
We do not process card payments and never receive your GCash credentials. We receive only the reference number you provide.
A reference number that cannot be matched to a received payment will be rejected and PRO will not be activated. If you believe this is in error, contact us with your proof of payment and we will review it.
Subscription fees are non-refundable once PRO has been activated, as the benefit is delivered immediately and in full.
We will refund in the following circumstances:
Refund requests should be sent to artedeals1@gmail.com with the reference number. Nothing here limits any right you may have under the Consumer Act of the Philippines.
Browse results are ordered by a weighted shuffle that changes on each visit, so that Listings are not permanently ranked by age. PRO Listings carry a heavier weighting and therefore appear near the top more often. Standard Listings continue to appear throughout the results and can rank above PRO Listings.
Increased visibility is not a guarantee of views, enquiries, or a sale. Buyers may also sort results by newest, price, or distance, which disregards weighting entirely.
The Platform provides direct messaging between Buyers and Sellers. Messages are stored so that both parties retain their conversation history.
You must not:
Any signed-in User may report a Listing. Reports are reviewed by administrators, and the Seller is not told who submitted them.
Following a review we may take any of the following steps: leave the Listing in place, remove it, contact the Seller, restrict the account, or terminate it. We may remove any Listing or account at our discretion, with or without a report, and without prior notice where the circumstances warrant it.
You retain ownership of the Listings, photographs, and messages you create.
By posting content you grant ARTE DEALS a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, resize, and display that content for the purposes of operating and promoting the Platform. This licence ends when you remove the content, save for copies retained in backups for a limited period, and for any copies others may have lawfully saved or shared.
You confirm that you hold the rights necessary to grant this licence.
The ARTE DEALS name, logo, wordmark, visual design, and the software behind the Platform are our property or licensed to us. You may not copy, reproduce, or create derivative works from them without written permission. Nothing in these terms transfers any right in our intellectual property to you.
Because ARTE DEALS is not a party to any sale, Buyers and Sellers deal with each other directly.
Meet in a safe, public place during daylight and view the vehicle in person before committing. Ask to see the Certificate of Registration and Official Receipt, and confirm the engine and chassis numbers match. Never send a deposit to someone you have not met.
Disputes arising from a transaction are between the Buyer and the Seller. We may, at our discretion, provide relevant records where required by law or lawful request, but we do not mediate, arbitrate, or guarantee any outcome.
You may stop using the Platform at any time and may request deletion of your account as described in our Privacy Policy.
We may suspend or terminate an account that breaches these terms, is the subject of credible reports, or appears to be operating fraudulently. Where an account is terminated for a breach, any unused portion of a PRO subscription is forfeited and no refund is due.
On termination, your Listings are removed from public view. Sections that by their nature should survive — including intellectual property, limitation of liability, indemnity, and governing law — continue to apply.
The Platform is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, error-free, or free from delay.
We rely on third-party providers for hosting, database services, image delivery, email, and location search. Interruption or failure of any such provider may affect the Platform, and we are not liable for their acts or omissions. Links to third-party services are provided for convenience and imply no endorsement.
To the fullest extent permitted by Philippine law:
Nothing in these terms excludes liability for fraud, wilful misconduct, or any liability that cannot lawfully be excluded.
You agree to indemnify and hold ARTE DEALS harmless from any claim, demand, loss, or expense, including reasonable legal fees, arising from your use of the Platform, your Listings or content, your breach of these terms, or your violation of any law or the rights of a third party.
These terms are governed by the laws of the Republic of the Philippines, without regard to conflict of law principles.
If a dispute arises between you and ARTE DEALS, we ask that you first contact us so we can try to resolve it directly. Most matters are settled this way. Where a dispute cannot be resolved, it shall be submitted to the exclusive jurisdiction of the competent courts of Metro Manila, Philippines.
We may amend these terms as the Platform develops or as the law requires. The effective date at the top of this page shows when they last changed, and material changes will be announced on the Platform.
Continuing to use ARTE DEALS after a change takes effect constitutes acceptance of the amended terms. If you do not accept them, stop using the Platform and request deletion of your account.
These terms, together with the Privacy Policy, constitute the entire agreement between you and ARTE DEALS regarding the Platform.
If any provision is found unenforceable, the remaining provisions continue in full force, and the unenforceable provision shall be interpreted so as to give effect to its intent as closely as the law allows.
Our failure to enforce any provision is not a waiver of our right to enforce it later.
You may not assign or transfer your rights under these terms. We may assign ours in connection with a merger, acquisition, or transfer of the business, on notice to you.
We may give notice by email to the address on your account or by posting on the Platform. Notices to us should be sent to the address in section 24.
Neither party is liable for failure to perform caused by events beyond reasonable control, including natural disasters, power or network failure, or government action.
